Terms of Service

By accessing or using the TakeCharge mobile application ("App") or renting a powerbank from TakeCharge stations, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service
TakeCharge provides portable powerbank rental services through physical stations and the TakeCharge mobile app. Users can rent powerbanks with built-in cables and return them to any TakeCharge station.

2. Eligibility
You must be at least 13+ years old to use the Service. By using the Service, you represent that you meet this requirement.

Children's Privacy
The Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under 13, do not use the Service or provide any information.

3. Rental Rules
• Powerbanks must be returned to any TakeCharge station in good condition.
• Rental charges are calculated per hour (current rate: $4.00/hour).
• Daily maximum charge: $20 (or equivalent in local currency).
• Lost, damaged, or non-returned powerbank fee: $49.
• A security deposit may be pre-authorized on your payment method and refunded upon successful return.

4. Payments and Refunds
• Payments are processed through our payment provider (Stripe).
• Refunds for deposits and overcharges are processed automatically upon return.
• All charges are final and non-refundable except as required by law.

5. SMS and Notifications
By providing your phone number, you consent to receive transactional SMS messages (verification codes, rental confirmations, return reminders, overdue notices). Message and data rates may apply. Reply STOP to unsubscribe from non-essential messages.

6. User Responsibilities
• You are responsible for the powerbank while rented.
• Do not tamper with, disassemble, or misuse the powerbank.
• Report lost or stolen powerbanks immediately to support@takechargeapp.com.

7. Limitation of Liability
To the fullest extent permitted by law, TakeCharge is not liable for:
• Damage to your device caused by using our powerbanks
• Loss of data, indirect, or consequential damages
• Service interruptions or station availability

8. Intellectual Property
The TakeCharge app, brand, and service are owned by Take Charge Power LLC. You may not copy, modify, or distribute any part without permission.

9. Termination
We may suspend or terminate your access if you violate these Terms or for any reason with notice.

10. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.

11. Changes to Terms
We may update these Terms. Continued use of the Service constitutes acceptance of changes.
